La diversit\u00e9 et la complexit\u00e9 du patrimoine des clients UHNWI peut s\u2019av\u00e9rer difficile \u00e0 couvrir en mati\u00e8re de risque.&nbsp;<\/p>\n\n\n\n<p>La police d\u2019assurance est, par nature, un instrument tr\u00e8s standardis\u00e9 : pens\u00e9e pour s\u2019adapter, \u00e0 quelques ajustements pr\u00e8s, \u00e0 toute une cat\u00e9gorie de biens. C\u2019est pr\u00e9cis\u00e9ment ce qui la rend mal arm\u00e9e pour couvrir des actifs d\u2019exception, des patrimoines complexes et mouvants ou des personnes ultra-mobiles.<\/p>\n\n\n\n<p><strong>I. IARD : ce qui bouge est mal couvert<\/strong><\/p>\n\n\n\n<p>Ce qui fait la valeur des actifs d&#8217;exception, leur raret\u00e9, leur caract\u00e8re transportable, est ce que la police IARD ordinaire g\u00e8re le plus mal. Elle a \u00e9t\u00e9 pens\u00e9e pour couvrir un bien&nbsp;<em>quelque part<\/em>, pas un bien en mouvement.<\/p>\n\n\n\n<p>Une collection d&#8217;art l&#8217;illustre bien. Assurer une \u0153uvre accroch\u00e9e chez son propri\u00e9taire ne pose pas de difficult\u00e9 majeure. Mais d\u00e8s lors qu\u2019elle est donn\u00e9e en pr\u00eat, envoy\u00e9e \u00e0 l\u2019\u00e9tranger pour une vente ou une exposition, ou qu&#8217;elle transite par un port franc, la couverture habituelle devient souvent insuffisante. C&#8217;est pourtant pendant ce transit que l&#8217;\u0153uvre court le plus de risques. D&#8217;o\u00f9 l&#8217;int\u00e9r\u00eat d&#8217;une garantie \u00ab clou \u00e0 clou \u00bb, qui la suit du d\u00e9crochage au raccrochage, quels que soient les pays travers\u00e9s.&nbsp;<\/p>\n\n\n\n<p>En mati\u00e8re de yacht ou de jet, les polices connaissent des limites de navigation : elles fixent une zone autoris\u00e9e au-del\u00e0 de laquelle la garantie est suspendue, et l&#8217;aviation priv\u00e9e ajoute la question des territoires survol\u00e9s et des espaces sous sanctions. Autant de conditions de validit\u00e9 dont on oublie souvent de se pr\u00e9occuper au moment de la conclusion du contrat.<\/p>\n\n\n\n<p>Le contrat ne couvre que le risque qu&#8217;on lui a d\u00e9clar\u00e9. Pour un client mobile et tr\u00e8s actif, souscrire ne suffit donc pas : la d\u00e9claration doit suivre un usage par nature mouvant, et c&#8217;est au conseil de porter cette actualisation. Une nuance prend d&#8217;ailleurs beaucoup d&#8217;assur\u00e9s \u00e0 contre-pied : la valeur agr\u00e9\u00e9e prot\u00e8ge contre une mauvaise estimation du bien, jamais contre une exclusion. Un actif parfaitement valoris\u00e9 peut ainsi se trouver hors couverture, pour la seule raison qu&#8217;il \u00e9tait l\u00e0 o\u00f9 le contrat ne l&#8217;attendait pas.<\/p>\n\n\n\n<p><strong>II. Assurance de personnes : la fronti\u00e8re qui annule la garantie<\/strong><\/p>\n\n\n\n<p>Ce qui vaut pour les biens vaut aussi pour la personne.&nbsp;<\/p>\n\n\n\n<p>Les contrats sant\u00e9 et pr\u00e9voyance pr\u00e9supposent presque toujours un pays de r\u00e9sidence et un r\u00e9seau de soins ; le client qui passe l&#8217;essentiel de l&#8217;ann\u00e9e ailleurs cumule les angles morts. Une couverture sant\u00e9 nationale prend mal en charge les soins \u00e0 l&#8217;\u00e9tranger, en particulier aux \u00c9tats-Unis, o\u00f9 une hospitalisation atteint des montants difficiles \u00e0 concevoir : seule une v\u00e9ritable assurance sant\u00e9 internationale, \u00c9tats-Unis inclus, garantit la continuit\u00e9. Or beaucoup de contrats les excluent pr\u00e9cis\u00e9ment pour contenir la prime.&nbsp;<\/p>\n\n\n\n<p>C\u00f4t\u00e9 pr\u00e9voyance, les exclusions li\u00e9es aux d\u00e9placements visent le quotidien m\u00eame du grand voyageur : zones \u00e0 risque, sports \u00e0 sensations, aviation de loisir, navigation hauturi\u00e8re. Un accident pendant l&#8217;une de ces activit\u00e9s, et la garantie dispara\u00eet \u00e0 l&#8217;instant o\u00f9 elle aurait d\u00fb jouer.<\/p>\n\n\n\n<p>Il est donc primordial de veiller \u00e0 la r\u00e9daction des contrats d\u00e8s la souscription, afin de ne pas se retrouver dans un cas d\u2019exclusion lors de la survenance d\u2019un sinistre.<\/p>\n\n\n\n<p><strong>III. L\u2019assurance \u00e9pargne et l\u2019Universal Life Insurance<\/strong><\/p>\n\n\n\n<p>En Europe continentale, on \u00e9voque presque syst\u00e9matiquement l\u2019assurance vie, souvent luxembourgeoise, enveloppe de placement devenue incontournable qui cumule un volet principal d\u2019\u00e9pargne capitalisante auquel s\u2019ajoute une composante, souvent secondaire, de pr\u00e9voyance et planification successorale (couverture du risque li\u00e9 au d\u00e9c\u00e8s de l\u2019assur\u00e9). Le capital d\u00e9c\u00e8s correspond alors en principe \u00e0 la valeur de rachat du contrat.<\/p>\n\n\n\n<p>A contrario, les contrats dits Universal Life, eux, restent mal connus et demeurent surtout l\u2019apanage des march\u00e9s anglo-saxons.&nbsp;<\/p>\n\n\n\n<p>L&#8217;Universal Life est, \u00e0 l&#8217;origine, un v\u00e9ritable contrat d&#8217;assurance-d\u00e9c\u00e8s \u00e0 prime flexible, con\u00e7u dans la tradition anglo-saxonne o\u00f9 l&#8217;assurance-vie sert d&#8217;abord \u00e0 garantir le versement d&#8217;un capital au d\u00e9c\u00e8s. La composante de protection y est centrale et structurellement pr\u00e9pond\u00e9rante, m\u00eame si le contrat comporte une valeur de rachat qui se capitalise.<\/p>\n\n\n\n<p>Le capital d\u00e9c\u00e8s est structurellement sup\u00e9rieur \u00e0 la valeur de rachat, \u00e0 l\u2019inverse du cas pr\u00e9c\u00e9dent. Le contrat garantit le versement d&#8217;un capital d\u00e9c\u00e8s d\u00e9fini, tandis que la valeur de capitalisation peut \u00eatre bien inf\u00e9rieure. La diff\u00e9rence entre les deux est le capital dit sous risque, r\u00e9ellement assur\u00e9 et tarif\u00e9 par l&#8217;assureur via des co\u00fbts d&#8217;assurance.<\/p>\n\n\n\n<p>Ces deux outils sont en r\u00e9alit\u00e9 compl\u00e9mentaires et doivent faire l\u2019objet d\u2019un traitement particulier dans les situations internationales notamment en mati\u00e8re de qualification fiscale, traitement successoral et obligations d\u00e9claratives.<strong><\/strong><\/p>\n\n\n\n<p><strong>Conclusion<\/strong><\/p>\n\n\n\n<p>Chez les clients UHNW, le levier assurantiel demeure trop souvent sous-exploit\u00e9, r\u00e9duit \u00e0 sa dimension de placement quand il devrait \u00eatre pens\u00e9 comme un v\u00e9ritable instrument de protection.&nbsp;<\/p>\n\n\n\n<p>Or les trois axes \u00e9voqu\u00e9s, biens d\u2019exception, couverture des personnes et solutions d\u2019\u00e9pargne hybrides, ne prennent leur sens qu\u2019articul\u00e9s entre eux, \u00e0 la lumi\u00e8re de la mani\u00e8re dont le patrimoine est r\u00e9ellement d\u00e9tenu, d\u00e9plac\u00e9 et transmis.&nbsp;<\/p>\n\n\n\n<p>Le r\u00f4le du conseil n\u2019est plus seulement de souscrire des polices, mais d\u2019auditer l\u2019exposition globale du client et d\u2019ajuster les garanties dans le temps.
