Elle modifiera notamment les r\u00e8gles qui gouvernent le d\u00e9membrement de propri\u00e9t\u00e9.<\/strong><\/em><\/h3>\n\n\n\n<p>Si la r\u00e9forme du droit des biens concerne notamment le droit de propri\u00e9t\u00e9, la copropri\u00e9t\u00e9, les droits r\u00e9els d\u2019usage et les s\u00fbret\u00e9s r\u00e9elles, elle aura un impact important en mati\u00e8re de d\u00e9membrement de propri\u00e9t\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Diminuer le risque de conflits entre usufruitier et nu-propri\u00e9taire<\/h2>\n\n\n\n<p>La r\u00e9forme modifie en effet les r\u00e8gles qui concernent la r\u00e9partition des frais de r\u00e9paration li\u00e9s aux travaux du bien.<\/p>\n\n\n\n<p>Le r\u00e9gime actuel dispose que les grosses r\u00e9parations sont \u00e0 la charge du nu-propri\u00e9taire, tandis que l\u2019usufruitier doit se contenter d\u2019assumer les d\u00e9penses d\u2019entretien, beaucoup moins on\u00e9reuses. La r\u00e9forme instaure un m\u00e9canisme beaucoup plus \u00e9quitable: elle pr\u00e9voit d\u00e9sormais que l\u2019usufruitier devra participer au financement des grosses r\u00e9parations \u00e0 concurrence de la valeur de son usufruit. D\u00e8s lors, si l\u2019usufruitier a un usufruit de 70 %, les frais des grosses r\u00e9parations seront support\u00e9s par lui \u00e0 concurrence de 70 %.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">R\u00e9partition plus \u00e9quitable<\/h2>\n\n\n\n<p>Prenons l\u2019exemple d\u2019un couple mari\u00e9 avec enfants : au d\u00e9c\u00e8s d\u2019un des parents, le conjoint survivant obtient l\u2019usufruit sur le logement principal et la nue-propri\u00e9t\u00e9 revient aux enfants. Les r\u00e8gles en vigueur jusque septembre 2021 impliquent que les enfants, qui sont nu-propri\u00e9taires, devront supporter les frais de toutes les grosses r\u00e9parations, alors qu\u2019ils ne pourront jouir pleinement de ce bien avant de nombreuses ann\u00e9es. La r\u00e9forme aura pour cons\u00e9quence de faire supporters une partie de ces frais par l\u2019usufruitier \u00e0 concurrence de la valeur de son usufruit. Le montant r\u00e9siduel sera \u00e0 charge des nus-propri\u00e9taires.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Comment calculer la valeur de l\u2019usufruit<\/h2>\n\n\n\n<p>L\u2019usufruit se calcule conform\u00e9ment aux tables l\u00e9gales de conversion, dont les donn\u00e9es sont mises \u00e0 jour chaque ann\u00e9e par arr\u00eat\u00e9 royal. Celles-ci permettent de convertir la valeur estim\u00e9e de l\u2019usufruit d\u2019une mani\u00e8re uniforme en un montant d\u2019argent.<\/p>\n\n\n\n<p>La loi du 22 mai 2014 \u00e9tablit deux tables de conversion : l\u2019une pour les hommes et l\u2019autre pour les femmes. Sauf si les parties en ont convenu autrement, la valeur de l\u2019usufruit est calcul\u00e9e sur la base des tables de conversion, de la valeur v\u00e9nale des biens et de l\u2019\u00e2ge de l\u2019usufruitier au jour de l\u2019introduction de la requ\u00eate.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Dispositions transitoires<\/h2>\n\n\n\n<p>La nouvelle loi s\u2019applique \u00e0 tous les actes juridiques et faits juridiques qui ont eu lieu apr\u00e8s la date d\u2019entr\u00e9e en vigueur, c\u2019est-\u00e0-dire, au 1er septembre 2021.<\/p>\n\n\n\n<p id=\"vigueur\">Il sera cependant possible pour les parties de convenir, par le biais d\u2019un accord, que les effets de la pr\u00e9sente loi s\u2019appliqueront aux effets futurs des actes juridiques et faits juridiques survenus avant son entr\u00e9e en vigueur<sup><strong><a href=\"#lexique1\">[1]<\/a><\/strong><\/sup>.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p id=\"lexique1\"><strong><a href=\"#lexique1\">[1]<\/a><\/strong> Article 37 de la loi du 4 f\u00e9vrier 2020 portant sur le livre 3 du Code civil,&nbsp;<em>M.B.,&nbsp;<\/em>17 mars 2020.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La r\u00e9forme modifiant les dispositions relatives au droit des biens entrera en vigueur le 1er septembre 2021.
